Falcon Portal User Agreement

PLEASE READ AND AGREE TO THIS USER AGREEMENT BEFORE APPLYING FOR ACCESS TO THE PRIVATE CUSTOMER PORTAL (the "Portal") OF THE DASSAULT FALCON ("DF") WEBSITE.

Access to Falcon's Private Customer Portal is granted only to current and active Falcon Owners, Operators, Authorized Service Centers, Authorized Partners and Vendors, and employees of Dassault. If you do not fall into one of these categories yet believe you should have access, please contact us.

USER IDs & PASSWORDS
You are responsible for the confidentiality of your User ID and Password. If you become aware of any unauthorized use of your User ID or Password, you agree to immediately notify DF Customer Service by telephone at 201-541-4735 (US) or 33 (1) 47 11 51 14 (France) and confirm the notice in writing via e-mail to customer.service.communications@falconjet.com or via regular mail to the User Agreement Coordinator, DFJ Customer Service, Teterboro Airport, Box 2000, South Hackensack, NJ 07606 or Dassault Aviation, Falcon Customer Service, User Agreement Coordinator, 78 Quai Marcel Dassault, Cedex 300, 92552, Saint-Cloud, France. You agree not to share your User ID and Password with others unless for the sole purpose of working on Falcon aircraft which you own or are responsible for maintaining, operating or managing. Proof of Falcon aircraft ownership will be required to grant User IDs and passwords.

*Please note that Portal sessions will remain active for as long as there is activity by the Portal user. For security and to maintain the privacy of proprietary data, sessions will time-out after 30 minutes of inactivity. Users will then need to log back in.

ACCESS TO INFORMATION, PERMITTED USE, TERMINATION OF ACCESS
The information available in DF's Private Customer Portal is protected under US and foreign copyright laws. Information received through this Portal may only be stored in memory, manipulated, analyzed, reformatted, printed and displayed for your personal, non-commercial use. You agree not to reproduce, retransmit, disseminate, sell, distribute, publish, broadcast or circulate the information received through the Portal to anyone including, but not limited to, others in your company or organization who do not have a need to know this information in question, without the express prior written consent of DF. DF reserves the right for any reason to discontinue Portal Access for any User. You understand that DF does not itself endorse or take responsibility for the views, opinions or recommendations made by you or other users of the Portal in whatever format, nor does DF advocate the purchase or sale of any spare part, piece of equipment or service mentioned by you or other users of the Portal unless expressly stated by DF. You understand that you may be held liable and accountable for any information, erroneous or otherwise, which you obtain from the Portal and then disseminate to others in contravention of this Agreement.

PRIVACY
DF makes efforts to protect your privacy while using the Portal. Our current Privacy Policy is available at: http://www.dassaultfalcon.com and is incorporated herein by reference and made a part of the Terms and Conditions. DF reserves the right to change these Terms and Conditions at any time.

DISCLAIMER OF WARRANTIES AND LIABILITY
Due to the number of sources from which the information on the Portal is obtained, and the inherent difficulties associated with electronic distribution, there may be delays, omissions or inaccuracies in the information provided through the Portal. User agrees that the Portal is not intended to and does not replace other existing methods of communication between User and DF.

BY ACCESSING AND USING THE PORTAL, YOU AGREE THAT DF, ITS DIRECTORS, OFFICERS, EMPLOYEES OR OTHER REPRESENTATIVES SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS, DAMAGE OR INJURY CAUSED IN WHOLE OR PART BY YOUR ACCESS TO, AND USE OF, THE PORTAL, REGARDLESS OF THE NATURE OF AND REASON FOR THE LOSS, DAMAGE OR INJURY. DF EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, GUARANTEES, WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO YOUR ACCESS TO, AND USE OF THE PORTAL, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
